You also understand that a lot of proprietary, branded products, programmed or customized products are/will be sold or served through its network of services. You also understand and agree that the products and / or Services may include advertisements and that these advertisements are necessary for iVerticals.org to provide you the products and services. You also understand and agree that the products and/or services may include certain communications from iVerticals.org that these communications are considered part of iVerticals.org’s membership and you have to live with them as part of your membership. Any new features that are added to enhance our current product and/or services portfolio, including the release of new iVerticals.org products and / or servic es, they as well, shall be subject to this Terms of Usage and Services. You understand and agree that the products and services are provided "AS-IS" and that iVerticals.org assumes no responsibility for the deletion, timeliness, mis-delivery or failure to store any of user communications or personalized settings.

You also understand that third party products and/or services catered from iVerticals.org to you, iVerticals.org assumes no responsibility in any kind of dispute in regards to product and/or services quality, or financial disputes or any kind of disputes or dis-satisfaction between you & the third party. However we would like you to help us know your dis-satisfaction at andy_defonde@iverticals.org so that we can review the products and/or services of the party that we represent and would wish whole heartedly to improve upon our commitments of quality.

iVerticals.org is no way responsible to serve you with the access to this portal. It is your own responsibility to procure access protocols to get access to this portal’s contents. Any fee associated with this access is your own responsibility and iVerticals.org is no way responsible for any kind of financial liabilities of your access to the site.

3. YOUR REGISTRATION OBLIGATIONS

iVerticals.org is and will be concerned about the safety and privacy of all its users. Keeping it into perspective each every member of this portal who ever registers, is expected to submit most accurate information during registration. At any point of time if iVerticals.org finds any such occurrence where it is investigated to be a wrong registration information, iVerticals.org reserves the right to terminate your membership without any reason and without any financial obligation from iVerticals.org. Any financial transaction made at this site would be construed as a non-refundable transaction. Under the discretion of iVerticals.org, transactions can be made refundable. It is absolutely mandatory that users with less than 18 years old would need their legal guardian’s approval or consent to register with this site and any user registered with this site if found below 18 years will be assumed the legal guardian’s consent is available before he/she had registered with iVerti cals.org. It is absolute responsibility of the legal guardian to assess the contents of the site before allowing or approving their children having access to the contents. iVerticals.org will not be held under any circumstances for any users registered and less than 18 years of age.

4. MEMBER ACCOUNT, PASSWORD AND SECURITY

Post registration, you will receive your account information with password over an email from iVerticals.org. It is completely your own responsibility to keep your account confidential, safe and secure. We will advise you to select your password that is not easily discernible by any third party. You agree to the following:

(a) Notify immediately iVerticals.org of any unauthorized use of your account or any other breach of security, and
(b) You will exit from your account at the end of your access to your account with iVerticals.org.

IVerticals.org will not be responsible for any loss of vital information of your account.

5. MEMBER CONDUCT

You understand that all information termed here as “Content” whether publicly posted or privately transmitted, is the sole responsibility of the person from which such Content has originated. You & not iVerticals.org, are fully responsible for all Contents that you upload, post, email, transmit or otherwise make available via the services of iVerticals.org.

iVerticals.org does not control the Content posted via various services or products offered through this site and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the products & services, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will IVerticals.org be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the products & services.

You acknowledge and agree that iVerticals.org may preserve contents and may also disclose contents if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:

(a) Comply with legal process;
(b) Enforce the TOUS;
(c) Respond to claims that any content violates the rights of third-parties; or
(d) Protect the rights, property, or personal safety of iVerticals.org, its users and the public.

Internet being now a global environment of communications & media, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from your country of residence.

iVerticals.org will not claim any ownership of content that you submit or make available for inclusion on the products and/or services. However, with respect to content you submit or make available for inclusion on publicly accessible areas of the products and/or services, you grant iVerticals.org the following worldwide, and non-exclusive and royalty free license or licenses whichever as applicable.

The license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such content on the products &/or services solely for the purposes of providing and promoting the specific iVerticals.org content or program. This license exists only for as long as you elect to continue to include such content on the products and/or services and will terminate at the time you remove or iVerticals.org removes your account or information or content...

You agree not to use the products and/or services to:

6. CONFIDENTIALITY

Both parties hereby agree not to divulge nor communicate to a third party other than both of us, any confidential information that may have come to his/her knowledge by reason of or in connection with this agreement. Both the parties hereby also agree that they shall use all reasonable efforts to prevent their employees, officers, agents, consultants & contractors working with them on contractual terms from divulging confidentiality.

7. INDEMNITY

As a user, you agree to indemnify and hold iVerticals.org, its affiliates, or other partners and employees harmless, from and against any claims actions, demands, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the products &/or services, your use of the product(s) and/or services, your connection to the product(s) and/or services, your violation of the TOUS, liabilities, losses or damages whatsoever arising from or resulting from your use of iVerticals.org or your breach of the terms of this agreement.

8. MODIFICATIONS TO THE PRODUCTS AND OR SERVICES

iVerticals.org reserves the right at any point in time and from time to time to modify or discontinue, temporarily or permanently, the products and/or services [or any part thereof] with or without notice. You agree that iVerticals.org shall not be liable to you or to any third party for any modification, suspension or discontinuance of products or services.

9. TERMINATION OF SERVICE (S)

Either party to this agreement may terminate this agreement by giving prior notice in writing. Notwithstanding the above, the site management may terminate this agreement with immediate effect, without prior notice to the user and cause for such termination shall include, but not limited to,

a) Breaches or violation of this TOUS or other incorporated agreements or guidelines
b) Requests by law enforcements or other governmental organizations or agencies
c) a request by yourself [self – triggered account deletions]
d) Discontinuance or modifications of any of the content to the products and / or services or any part thereof
e) Unexpected technical /financial issues or problems
f) Extended period of in-activity.
g) If the user is declared bankrupt or the user enters into any compromise with its creditors.

Termination of your iVerticals.org would include removal of all access to any and all the contents of this portal. If at any point of time you had earlier purchased any products, the licenses for those products would not be ceased and would remain your personal property.

If there is any subscription-based fee associated with the relationship with the user, user has to pay the financial liabilities till the date of termination. Date of termination therefore would be construed as the date when the account had been deleted from the software application infrastructure of this portal.

10. SUSPENSION OF SERVICES

Without prejudice to any other rights or remedies of iVerticals.org, the site management may suspend the services provided by iVerticals.org in the event that in case of any financial overdue liability. Your account will be terminated from the date stipulated by iVerticals.org. Upon paying the full dues, if the user wants to resume the services, a basic reconnect charge shall have to be paid by the user and the fee will be based on iVerticals.org’s financial rates & charges prevailing at that point of time.

11. PRIVACY POLICY

This policy covers how iVerticals.org treats personal information that IVerticals.org collects and receives, including information related to your past use of iVerticals.org products and services. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available.

This policy does not apply to the practices of companies that iVerticals.org does not own or control, or to people that iVerticals.org does not employ or manage.

iVerticals.org maintains a strict confidentiality policy on all personal data submitted by Job Seekers or by employers. iVerticals.org will not release any information under normal circumstances to anybody without having your consent.

However depending upon business requirements and decisions made by iVerticals.org management, it is assumed that whoever registers in the employers section reserves the right to view & communicate with the job seeker at any point of time, if he/she had maintained his/her personal information in the site. iVerticals does not have any functionality or capability and does not intend to have it in near future (but absolutely at the discretion of the iVerticals.org management to implement such functionalities if it decides to have it), to prevent anybody registered within employer section from viewing the job seeker(s) personal information.

In such cases iVerticals is no way responsible to protect personal information to the employers the job seeker does not want to see or view. In such cases Job Seeker is requested to abstain from registration.

Personal information is taken for the sole purpose of assisting the Job Seeker to appropriate employer and exposing the employer to the job seekers so that they are aware which company they are willing to apply for job/career.

Transferring data, iVerticals.org is no way responsible to transmit your personal data to corporations. The emails or fax that employers would receive is only when you use the functionality to email or fax your personal information.
